Terms of Use

What CannSample is

CannSample lets cannabis brands give product samples to verified retail staff and keep a record of every sample. Brands add products and campaigns, their reps scan a budtender's QR code, and each sample is logged. CannSample is a record-keeping tool. We don't sell, ship or handle cannabis products.

Who can use it

• You must be of legal age to work with cannabis in your province.
• Budtenders must work at a licensed cannabis retail store and hold any certification their province requires.
• Brand accounts are for licensed cannabis brands and the people authorized to act for them.
• You must give accurate information and keep it up to date.

Your account

• Keep your password private. You're responsible for what happens under your account.
• Your QR code is personal to you. Don't share it or let anyone else use it to receive samples.
• One account per person. Don't create an account for someone else or pretend to be someone else.
• Tell us right away if you think someone else has used your account.

Verification

We review budtenders before they can receive samples, and brands before their accounts go live. We may contact your store or check public certification registries to do this. We decide whether to verify or approve an account, and we may remove verification if information turns out to be wrong.

For budtenders

• Joining CannSample is free.
• Brands decide what they sample, to whom and how much. Being verified doesn't guarantee you'll receive any particular sample.
• Accept samples only as allowed by the law and your employer's policies. Samples are not for resale.
• Feedback you leave should be honest and based on your own experience.

For brands

• You're responsible for making sure your sampling, promotions and events follow federal and provincial cannabis laws and any rules from regulators or retailers. CannSample helps you keep records, but it doesn't give legal advice or make your activity compliant.
• Keep your product information, inventory and campaign details accurate.
• You're responsible for your reps and what they do in the app.
• Use budtenders' information only for your sampling records, compliance and following up about your products, and protect it as privacy law requires. Don't sell it or use it to spam people.
• Fees are set out in your agreement with us. Free or promotional periods last only as long as we tell you in writing.

What you can't do

• Break the law or help anyone else break it.
• Record samples that didn't happen, or alter or fake records.
• Access accounts or information that aren't yours, or try to get around our security.
• Copy, scrape or resell CannSample or the information in it.
• Harass anyone or post anything abusive, misleading or unlawful.
• Interfere with how CannSample works for other people.

Community guidelines

The Community is a private space for verified budtenders and approved brands. Posts show your first name and last initial to other members.

• Be respectful. No harassment, hate, threats or personal attacks.
• Don't share anyone's personal information, including customers' or coworkers'.
• Don't sell, buy or arrange to trade cannabis, and don't offer samples outside CannSample.
• No spam or self-promotion outside your own brand's community.
• Brands are responsible for making sure their posts follow cannabis promotion rules, and must not offer budtenders inducements to push their products.
• Speak for yourself, not your employer, unless you're authorized to.

Anyone can report a post or comment. We, and brands in their own community, may remove content, and we may suspend community access for anyone who breaks these guidelines.

Your content

You keep ownership of what you add, like product details and feedback. You give us permission to store and use it to run CannSample, and you agree that feedback you leave about a product can be shared with that product's brand.

CannSample itself, including the app, design and logo, belongs to us. You may use it only as these terms allow.

Suspending or closing accounts

You can stop using CannSample and ask us to close your account at any time. We may suspend or close an account that breaks these terms, puts others at risk, or has inaccurate verification information. Sample records already given to brands stay with them as compliance records.

No guarantees

We work hard to keep CannSample running smoothly, but it's provided “as is.” We don't promise it will always be available or error-free, and we're not responsible for products brands give out or for what users do.

Limits on our liability

To the extent the law allows, we're not liable for indirect or consequential losses, such as lost profits or lost data. Our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim, or $100 if you haven't paid us anything. Nothing in these terms limits rights you have that the law doesn't allow us to limit.

Brands agree to cover our costs if a claim against us arises from their sampling activity or from their breaking these terms.

Changes to these terms

We may update these terms. We'll change the date at the top, and if a change is significant, we'll let you know in the app before it takes effect. Continuing to use CannSample after that means you accept the updated terms.

Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
